Can I Sue a Contractor for Poor Workmanship?

Selecting a contractor to do work on your house is often a complex and detailed process. Even with great care in selecting, poor workmanship is not impossible.

But can a contractor be sued for an unsatisfactory job? That depends on several factors.

Contract Disputes

Construction contract disputes are commonly handled in court. In many cases, these are seen in small claims court where they are quickly resolved, but in others, legal representation may be needed.

There are two primary ways a contract can be breached:

  • Material breach. This occurs when either party obviously and clearly deviates from the contract. Examples may include leaving a job unfinished, using defective parts and products, fraud, and cutting corners
  • Non-material breach. This occurs when a minor issue, such as a brand, is changed, color is slightly (but unnoticeably) changed, or practical considerations cause slight delays

In many cases, a non-material breach can be resolved out of court. So too can some material contract breaches.
