Despite the progress that we have made as a society, workplace discrimination is still a serious problem. Discrimination can leave you feeling hurt and powerless. You shouldn’t have to put up with any mistreatment as a prospective or current employee based on your protected status. 

People may be illegally discriminated against on the basis of:

  • National Origin
  • Religion
  • Age
  • Disability
  • Sexual orientation
  • Pregnancy
  • Marital Status

This is not an exhaustive list of legally protected classes. As an employee, you have the right to be free from unlawful discrimination or harassment. If you are a job applicant, you are legally protected from discrimination during your hiring process.

It can be helpful to create a record of any instances of discrimination. Write down when the actions occurred, who was involved, and the names of any witnesses.

Know Your Rights

Many state and federal laws are in place to protect employees from workplace discrimination. State laws tend to vary regarding who is a protected individual and how the laws apply to employers.

The vast majority of workplace discrimination and harassment laws were enacted after the Civil Rights Movement of the 1960’s. They offer protection for many personal characteristics but not for relevant workplace concerns such as job performance or attitude.

You may be protected under:

  • Title VII: As part of the Civil Right Act of 1964, Title VII prohibits discrimination based on sex, race, religion, and national origin.
  • Americans With Disabilities Act (ADA): This act defines qualifying disabilities and outlines the protections that are available to disabled individuals.
  • Age Discrimination in Employment Act: If you are over 40 years of age, you may be protected under this act.
  • Equal Pay Act: Employers covered by the Fair Labor Standards Act are required to pay men and women the same pay for “equal work” under the Equal Pay Act.
